Essex County Courts
With a population of approximately 823,928, Essex County residents constitute about 11.5% of the over 7.1 million people living in Massachusetts. To serve its residents, the county operates a multi-layered court system designed to uphold justice, resolve disputes, and protect individual rights. The court system consists of five primary courts, each responsible for handling specific types of cases:
- Essex County Superior Courts: Handle all first-degree murder cases, civil actions exceeding $50,000, and labor disputes in which parties seek injunctive relief.
- Essex and Lawrence Probate and Family Courts: Oversee a wide range of probate and family-related matters, including guardianship, parenting time, divorce, and estate administration.
- Lawrence District Court: Adjudicates felonies punishable by a sentence up to five years, city ordinance violations, misdemeanors, and small claims involving amounts up to $7,000.
- Northeast Housing Courts: Address small claims matters related to housing, eviction cases, and civil cases involving issues like breach of contract or property damage.
- Newburyport, Salem, Lawrence, and Lynn Juvenile Courts: Decide cases involving child abuse and neglect, juvenile delinquency, and juvenile rehabilitation.
Although Essex County no longer has an active county government, its courts remain primarily located in the traditional county seats of Salem and Lawrence. These courts receive approximately 46,000 case filings each year. Of that total, more than 11,000 involve criminal matters, while about 6,400 pertain to probate cases. In addition, at least 3,500 small claims and 7,800 domestic relations cases are filed annually.
How To Access Essex County Court Records
Essex County court records maintained by the Clerk's Office are presumed open to public inspection under the Uniform Rules on Public Access to Court Records (Trial Court Rule XIV). Accordingly, anyone may request to view or obtain copies of court records during regular business hours at the Clerk's Office.
However, this presumption of access is subject to limitations that safeguard privacy, confidentiality, and individual safety. Certain records are legally protected from disclosure and cannot be made available to the public. These include, but are not limited to, grand jury proceedings, adoption files, and records related to mental health or substance use disorder commitments.
To access Essex County court records, interested parties may be required to provide a case number, citation number, names of parties or attorney, a filing date, or valid identification. These records may be obtained through the following methods:
Online
Electronic access to Essex County court records is governed by Rule 5 of the Uniform Rules on Public Access to Court Records. This rule permits individuals to view civil and criminal docket information electronically, provided the records are not exempt from disclosure. The Massachusetts Trial Court Case Access Portal allows users to search for case information by entering a case number, case type, or party name. However, certain records, such as those involving sexually dangerous persons or domestic abuse, are generally restricted from electronic access.
For federal civil and criminal cases arising in Essex County, interested parties may use the Public Access to Court Electronic Records (PACER) system. Upon creating an account on the PACER website, users may search for cases by case number, keywords, or party names and download case documents for a small fee, typically $0.10 per page.
Additionally, individuals may access recent county and federal case records through CourtCaseFinder. This website allows users to conduct instant case lookups for publicly aggregated court records across the United States.
In-Person
The Court Clerk typically maintains official documents related to a case in the court where the case was processed. As a result, interested parties may visit the appropriate Clerk's Office to inspect or request copies of court records. In addition, each courthouse provides public access computers that allow users to view case records free of charge.
Individuals requesting attested or unattested copies of court records in Essex County may be required to pay a nominal fee. Generally, an attested copy of a court record, including a docket sheet, register, or other document maintained by the Court Clerk, costs $2.50 per page. In contrast, unattested copies or standard printouts of court documents typically cost $0.50 per page.

Anyone seeking old or archived court records from Essex County may consult published transcripts and indexes available in university libraries or major public institutions, such as the Boston Public Library. How To File a Case in Essex County
Two significant factors that influence how a case is filed in Essex County are the type of court and the nature of the case. Accordingly, filers need to identify the court with the appropriate jurisdiction, which may be confirmed by contacting the court clerk. Additionally, required filing forms may vary depending on the case type; hence, consulting an attorney is recommended to prevent incorrect filings or potential case dismissal.
In Essex County, all housing-related cases must be filed online through eFileMA. In contrast, civil, probate, and family cases may be filed online, by mail, or in person at the appropriate Clerk's Office. To initiate a civil case with the Lawrence District Court, individuals may first consult the Court's Self-Help guide to gain a clear understanding of the filing process and its requirements. After reviewing the guide, filers may access the necessary court forms on the court's website and submit them using any of the acceptable filing methods.
Furthermore, when filing with the Essex Probate and Family Courts, individuals are encouraged to submit their petition or complaint to the filing clerk in person. This approach allows the clerk to review the documents for completeness and accuracy, thereby helping to minimize errors.
Filing fees vary significantly based on the type of case and any additional processing charges. However, individuals filing petitions in the Probate and Family Courts, such as those associated with disabled or elderly abuse, support of a spouse or child, or termination of a conservator or guardian, may do so free of charge. Moreover, the court may grant a fee waiver to eligible individuals who cannot afford the costs associated with filing their case. To apply, individuals must complete an Affidavit of Indigency, which will be reviewed by a judicial case manager responsible for approving or denying the application.
